Palma is where matters are decided

The Special Delegation of the Spanish State Tax Administration Agency for the Balearic Islands, the Agència Tributària de les Illes Balears, the Regional Economic-Administrative Tribunal, the Mallorca Companies Registry and the Administrative Chamber of the High Court of Justice all sit in Palma. Every review, audit, administrative claim and court appeal brought by a taxpayer on the island is heard there, wherever that taxpayer lives.

Our work in Palma is therefore not occasional. It is where one appears, files submissions and appeals.

What we advise on

Companies and family groups

Corporate income tax, VAT, remuneration of directors and shareholders, related-party transactions and reorganisations. In the city's asset-holding companies and family groups the recurring question is whether the structure supports the characterisation given to it, and that question is better answered before an inspector asks it. See splitting a family property company.

Wealth, property and succession

Wealth tax, the temporary solidarity tax on large fortunes, succession planning under Balearic civil law and the taxation of purchases and sales. Property portfolios in Palma usually combine direct and corporate ownership, and the treatment of the two is not interchangeable.

New residents and non-residents

Transfer of tax residence to Spain, the inbound expatriate regime under article 93 of the Personal Income Tax Act, the allocation of taxing rights under the applicable treaty and the obligations of a non-resident owner. See the inbound expatriate regime and Spanish wealth tax for non-residents.

Proceedings and appeals

Data verification, limited review and inspection before the AEAT and the ATIB, claims before the Regional Economic-Administrative Tribunal of the Balearic Islands and appeals to the administrative courts. We come in at the first request for information, while the file can still be steered, rather than once the assessment has been signed.

An audit is not won with the written submission but with what was documented at the time. By the time the notice arrives, the room left is the room that was left open years earlier.

Meeting in Palma

The firm has a base in Palma and its office in Manacor. Meetings with clients in Palma are held in the city, and we equally arrange to meet at the client's premises or at the authority itself while a file is running.

A good deal of the work is also handled remotely, as is usual in matters conducted in writing and through the electronic filing system, and as clients who spend only part of the year on the island tend to prefer.

How we work

A single point of contact

You deal directly with the professional handling your matter. Files do not travel between departments and the analysis is not delegated.

Written and defensible advice

Our conclusions rest on the statute, on the rulings of the Directorate General for Taxation and on case law, and we say expressly when a question is unsettled. Where facts are missing, we identify them rather than assume them.

Three languages

We advise in English, German and Spanish, which in Palma is less incidental than it sounds: a good share of the city's wealth structures have a leg outside Spain.

If your matter lies in the Llevant district, we keep an open office in Manacor. For an overview of our tax practice across the island, see tax advisor in Mallorca.
